Noodle factory fined for food safety breaches

A Sydney noodle factory and its directors have been fined a combined $21,000 plus professional costs after its directors pleaded guilty to seven offences each under the Food Act 2003 in the Downing Centre Local Court on Tuesday 20 November 2018.

The NSW Food Authority successfully prosecuted Hui’s Noodle Factory, a fresh noodle manufacturing facility in Hurlstone Park NSW, and two of its directors for various food safety breaches relating to non-compliant labelling.

The breaches included failure to declare the presence of gluten, egg and tartrazine (a food additive) on the label as is required by the Food Standards Code.

The business had a poor history of compliance with food safety requirements and had been subject to previous enforcement action by the NSW Food Authority between 2010 and 2016 relating to hygiene, construction and labelling issues.

 Warning letters, improvement notices, penalty notices and a prosecution had been enacted upon the business in keeping with the NSW Food Authority’s escalated enforcement policy.

The factory was being inspected as part of the NSW Food Authority’s Fresh Noodle Project, a targeted initiative designed to encourage better compliance outcomes in businesses manufacturing fresh noodles.
