Nature and circumstances of offence
The defendant was convicted for the offence under section 21(1) of the Food Act 2003, failure to comply with the Food Standards Code, namely:
- Food Safety Standard 3.2.2 Clause 6(1)(a). Failure to store the food in such a way that it is protected from the likelihood of contamination.
- Food Safety Standard 3.2.2 Clause 9(a). Failure to when packing food; to only use packaging material that is fit for its intended use.
- Food Safety Standard 3.2.2 Clause 17(b)(i). Failure to supply warm running water, at or near each hand washing facility.
- Food Safety Standard 3.2.2 Clause 17(b)(ii). Failure to supply soap, at or near each hand washing facility.
- Food Safety Standard 3.2.2 Clause 19 (2). Failure to maintain fixtures, fittings and equipment to the required standard of cleanliness.
- Food Safety Standard 3.2.2 Clause 20(1)(b) Failure to maintain food contact surfaces of equipment in a clean and sanitary condition.
- Food Safety Standard 3.2.2 Clause 21(1). Failure to maintain all fixtures, fittings and equipment in good state of repair, having regard to their use.
- Food Safety Standard 3.2.2 Clause 22(a). Failure to have a temperature measuring device readily accessible.
- Food Safety Standard 3.2.2 Clause 24(1)(a). Failure to not permit live animals in areas in which food is handled, other than seafood or other fish or shellfish.
- Food Standards Code 3.2.3 Clause 3 (b). The food business failed to ensure the design and construction of food premises had adequate space for the activities to be conducted on the food premises and for the fixtures, fittings and equipment used for those activities.
- Food Standards Code 3.2.3 Clause 16. Failure to ensure that adequate toilets are made available for the use of food handlers working for the food business.
Decision
The Defendant did not attend court and was convicted in their absence under s 196 of the Criminal Procedure Act 1986 NSW.
Penalty
$4000 for each offence. Total of $44,000 for eleven (11) offences. $2,083.00 in costs was awarded.
