The defendant company was convicted of Four (4) Principal Offences under the Food Act 2003 (NSW). Offences Three (3), Five (5) and Six (6) were dealt with by Form 1, whereby the court takes these offences into account when determining the sentence for Principal Offences.

1. Section 21(1); Failure to comply with Food Standards Code 3.2.2, Clause 18(3)(a) – General duties of food businesses. 
2. Section 16(1); Handle food in a manner likely to render it unsafe.
3. Section 17(1); Handling food in a manner likely to render it unsuitable
4. Section 16(2); Sell unsafe food.
5. Section 16(2); Sell unsuitable food.
6. Section 19(1); Sale of food not complying with purchaser’s demand
7. Section 21(1); Failure to comply with Food Standards Code 3.2.2, Clause 7(1)(a) – Food Processing.
