Nature and circumstances of offence
The defendant company was convicted of eighteen (18) separate offences under section 21(1) of the Food Act 2003, for failing to comply with a provision of the Food Standards Code, being:
- Standard 3.2.2 Clause 19(1), in that it did not maintain the food premises to a standard of cleanliness where there is no accumulation of garbage, recycled matter, food waste, dirt, grease, or other visible matter, as required.
- Standard 3.2.2 Clause 17(1)(a), in that it did not maintain easily accessible hand wash facilities, as required, on two (2) occasions.
- Standard 3.2.2 Clause 17(1)(c), in that it did not ensure hand wash facilities are only used for washing hands, face and arms, as required, on two (2) occasions.
- Standard 3.2.2 Clause 20(1)(b), in that it did not ensure the food contact surfaces of equipment are in a clean and sanitary condition whenever food that will come into contact with the surface is likely to be contaminated, as required.
- Standard 3.2.2 Clause 24(1)(b), in that it did not take all practicable measures to prevent pests entering premises, as required.
- Standard 3.2.2 Clause 24(1)(c), in that it did not take all practicable measures to eradicate and prevent pest harbourage, as required.
- Standard 3.2.2 Clause 21(1), in that it did not maintain food premises and all fixtures, fittings and equipment used in connection with food handling in a good state of repair, as required, on two (2) occasions.
- Standard 3.2.3 Clause 12(2)(b), in that it did not ensure fixtures, fittings and equipment are designed, constructed, located and installed so they are able to be easily and effectively cleaned, as required.
- Standard 3.2.3 Clause 10(2)(a), in that it did not ensure floors are able to be effectively cleaned, as required.
- Standard 3.2.2 Clause 19(2), in that it did not maintain all fixtures, fittings and equipment to a standard of cleanliness where there is no accumulation of food waste, dirt, grease or other visible matter, including cleaning equipment, as required.
- Standard 3.2.3 Clause 7, in that it did not ensure sufficient natural or mechanical ventilation to effectively remove fumes, smoke, steam and vapours, as required.
- Standard 3.2.2 Clause 6(1)(a), in that it did not store food in such a way that it is protected from the likelihood of contamination, as required, on two (2) occasions.
- Standard 3.2.2 Clause 17(1)(d), in that it did not provide, at or near each hand wash facility, single use towels or other means to dry hands, as required.
- Standard 3.2.3 Clause 12(2)(c), in that it did not ensure walls and ceilings are able to be effectively cleaned, as required.
