Offences 31, 32, 33, 34, 35.
Contrary to section 122 of the Food Act 2003, the defendant, being Director of the food business L’Oven Bakery Supplies Pty Ltd, ought reasonably to have known the company was committing the following offences and failed to take all reasonable steps to prevent or stop the commission of those offences.
The defendant was convicted of five (5) separate executive liability offences under section 21(3) of the Food Act 2003, for selling food packaged in a manner that contravened the Food Standards Code, being:
- Standard 1.2.5 Clause 5(2)(a), in that it did not express date marking information as required.
- Standard 1.2.1 Clause 8(1)(d), in that it did not make mandatory declarations for the presence of wheat, egg and sesame seed ingredients as required.
- Standard 1.2.1 Clause 8(1)(e), in that it did not express statement of ingredients as required.
- Standard 1.2.1 Clause 8(1)(i), in that it did not display nutritional information on packages as required.
- Standard 1.2.1 Clause 8(1)(c), in that it did not display name and address of the supplier as required.
Penalty for offences 31, 34, 35: $2,500 each
Penalty for offences 32, 33: $5,000 each
