Enforcement agencies are appointed
Each NSW local council and the Secretary of the Department of Climate Change, Energy, the Environment and Water is appointed as an enforcement agency under the Food Act 2003 (NSW). The first appointments are from 1 July 2008.
The agencies are appointed under s 111 of the Food Act 2003 (NSW) after a consultation process.
Functions and categories
The Food Authority and agencies work together to be efficient and fair in how they enforce food safety and labelling standards. The NSW system is known as the Food Regulation Partnership.
The responsibilities of each agency are designed to minimise duplication and overlap. For example, food complaints taken by one organisation may be referred and investigated by another.
Each enforcement agency may exercise powers under the Food Act 2003, subject to the standard limitations and conditions imposed. An enforcement agency can, upon request, seek to vary limitations in the instrument of appointment. Appointments are limited to specific geographic areas.

Prescribed enforcement agencies
As well as enforcement agencies appointed as above:
- NSW Food Authority is created as an enforcement agency under s 4(1) of the Food Act 2003
- Lord Howe Island Board is prescribed as an enforcement agency for Lord Howe Island (cl 4 (1) and 14(5) Food Regulation 2015).
